ZERO TOLERANCE POLICY

DrBrucePereira, LLC is committed to providing a safe and professional environment for its staff and clients. This Zero Tolerance Policy outlines the standards of conduct expected of all clients and the possible consequences for violating behavioral and relational boundaries. By engaging our services, all clients agree to adhere to this policy.

As a means of helping us to offer a safe environment and good working relationships with all our clients, we ask that all clients understand our Zero Tolerance Policy and stance on how we deal with clients who violate behavioral and relational boundaries. While it is rare to see these behaviors, they do occasionally occur. We ask you to treat our staff courteously at all times. We believe that setting expectations right from the beginning of our partnership is beneficial for all parties.

DrBrucePereira, LLC values client feedback and is dedicated to facilitating client growth and a positive experience. We encourage open communication regarding any questions or concerns. We maintain a Zero Tolerance Policy against violence, abuse, harassment, and aggression in the workplace. Any client who violates appropriate behavioral and relational boundaries is subject to immediate service discontinuation. Such decisions are at the sole discretion of DrBrucePereira, LLC and are final.

This policy applies to all clients, including individual, enterprise, charity, and pro bono clients, and extends to all services and service lines offered by DrBrucePereira, LLC.

Partnership

Our engagements with clients are founded on a partnership model, rather than a contractor or employer-employee relationship. This framework promotes a thriving and productive coaching dynamic. Clients are encouraged to reflect on their reasons for seeking our services and to engage with our team in a manner that fosters mutual benefit, trust, respect and relational fit, which are essential for a successful coaching experience.

Increased Scope of Work

Any expansion of the scope of work beyond the initial agreement requires a formal discussion regarding licensing and financial adjustments. An updated Statement of Work (SOW) will be required to reflect these changes. DrBrucePereira, LLC will continue to provide services as originally agreed upon until the new SOW is executed and ratified by all parties.

Persistent and Egregious Intellectual Property Violations

The unauthorized use of DrBrucePereira, LLC's intellectual property (IP) is strictly prohibited. All clients are required to sign contractual agreements that include terms related to IP usage. Violation of these terms, including using IP outside the bounds of the contractual agreement, will be addressed directly and may result in legal action and a demand for appropriate compensation. Clients are responsible for ensuring they have obtained the necessary permissions before using any of our intellectual property.

Coach Observations & Feedback

Clients acknowledge that the coaching process may involve the coach providing observations and feedback on behaviors. Clients agree that their relationship with the coach is not based on power or authority over the coach as in other corporate relationships, but is an equal and collaborative partnership. Clients are expected to engage with their coach in a respectful manner.

Pro Bono and Charity Services

Pro bono or charity-based services, while offered free of charge, require the same level of commitment, effort, and attention as paid services. DrBrucePereira, LLC reserves the right to terminate pro bono services if a client is not valuing the service or is failing to meet their commitments. Pro bono services are not a right and are offered at the sole discretion of DrBrucePereira, LLC.

Persistent Relational Boundary Violations

Clients acknowledge that the coaching relationship is professional. While it's natural to feel a sense of deep connection with your coach, we ask that clients maintain professional boundaries. The pursuit of a personal or intimate relationship with a coach is considered a serious violation and will be addressed accordingly.

Conflict of Interests

DrBrucePereira, LLC reserves the right to discontinue sessions if a conflict of interest arises, if there are concerns about persistent relational boundaries, or there is a perceived lack of progress or commitment. In such cases, the situation will be discussed with the client, and DrBrucePereira, LLC will act in the best interest of both the client and the company.

Limits of Transparency

DrBrucePereira, LLC is committed to transparency regarding the services provided. However, clients acknowledge that the coaching or training relationship does not necessitate justifying our internal business operations, decisions, or prices.

Failure to Pay

Failure to make timely payments will result in a suspension of services until payment is received. Non-payment for services rendered may result in legal action.

Other Situations

The following behaviors will trigger a Zero Tolerance Review:

  • Swearing and/or verbal abuse towards our staff (in person, on social media, or emails)

  • Any form of physical violence or threat(s) of violence

  • Persistent unrealistic demands that cause stress to staff

  • Causing damage to, or stealing from our premises

  • Persistently arriving to sessions intoxicated

  • Engaging in illegal behavior on our premises or during sessions

  • Persistent tardiness or missing sessions without cancellation/rescheduling

  • Failure to pay for agreed services within agreed payment plans

  • Stalking our staff in-person or online

Serious Violations Resulting in Legal Action

DrBrucePereira, LLC reserves the right to seek legal action to resolve serious violations involving physical and emotional harm, loss, or illegal activity.

What to Expect

DrBrucePereira, LLC is committed to addressing any violations of this policy directly and with due process. In cases of serious and egregious violations, the relationship will be terminated immediately. For less egregious violations, DrBrucePereira, LLC will work with the client to understand the impact of the behavior and the expectations for the remainder of the engagement. All decisions to terminate are at the sole discretion of the business and are final.

Termination and Payment Reimbursement

For services paid in advance, DrBrucePereira, LLC does not offer refunds for sessions that have already been used. However, if a client has prepaid for a package and services are terminated, the client will be reimbursed for the unused sessions based on their chosen package, minus any applicable processing, administration and termination fees.

DrBrucePereira, LLC is committed to partnering with clients to create a productive exchange. Termination of services will only occur when the violation is egregious or when multiple attempts to address persistent violations have been made.
